In April 2013, we consulted Network Rail and train operators on our proposed contingency plan in the event that there is a delay to the formal implementation of the 2013 periodic review (PR13).
Following the consultation, we set out in paragraphs 22.29-22.46 of our draft determination our decision to proceed with this proposal. On 9 August 2013, we wrote to Network Rail and operators of regular scheduled passenger services asking them to include a provision within their track access contracts to give effect to the contingency plan. We did not ask freight and charter operators to include the provision following consideration of consultation responses from these operators (discussed further in our draft determination).
We have issued a template supplemental agreement for Network Rail and train operators to use to make the amendment to their track access contracts. We have also issued a general approval providing for the amendment to take effect without the need for our specific approval.
