This consultation invited suggestions for improvements to the clarity, consistency and simplicity of the contractual drafting of schedules 4, 7 and 8 of the model freight and passenger track access contracts.
The charging and incentives regime is set out in Schedules 4, 7 and 8 of the model contracts. As part of our 2018 periodic review of Network Rail (PR18), we are reviewing the charging and incentives framework in place between Network Rail and train operators. In January 2018, ahead of the process of amending the model contracts for the next control period (CP6), we invited suggestions from stakeholders on ways we could improve the clarity, consistency and simplicity of the contractual drafting in these model contracts.
Following careful review of the consultation responses, we published our conclusions to the consultation in July 2018. The scope of the consultation was limited to comments on the clarity, consistency and simplicity of the contractual drafting of these schedules. Therefore where we considered suggestions would require further policy consideration, they have not been taken forward as part of this workstream.
Where appropriate, we have reflected the suggestions made in Implementing PR18: consultation on changes to access contracts, which was published for consultation in July 2018.
