Changing our penalties statement

We consulted on some changes to our penalties policy, in light of the comments we received from our previous 'role of the regulator' consultation (December 2011).
These changes will give us more flexibility to consider accepting commitments to make improvements for passengers as an alternative to levying a financial penalty, where things have gone wrong and we find a penalty to be appropriate.
The changes should also incentivise operators to think about the impact problems have on their customers and could bring more immediate, tangible benefits than a financial penalty alone would.
