On 16 June 2015 Directive 2012/34/EU ("the Directive") came into force. Once France and the United Kingdom have transposed the Directive into domestic legislation, economic regulation of the Channel Tunnel will become the responsibility of ARAFER and ORR ("the authorities") as the independent regulator of France and the United Kingdom, respectively. Together, the authorities will ensure that principles of transparency, predictability, fairness and non-discrimination are observed in relation to the Channel Tunnel. In advance of the transfer of responsibilities, the authorities are working together in preparation for their new role.
